Thanks for reading the Elanso Information Technology Co. Ltd. (hereinafter referred
to as "Elanso" or “We”) Privacy Policy. The practices of this Privacy
Policy apply to the website located at http://www.elanso.com/
(including the Web and Wireless Internet, collectively referred to as the "Site").
This Privacy Policy governs the information we collect about you, and your use of
the information we provide to you. This Privacy Policy is incorporated into
and subject to the terms and conditions of the Elanso User Agreement. By accepting
this Privacy Policy and the User Agreement when you register with Elanso, you expressly
consent to our use and disclosure of your personal information in the manner described
in this Privacy Policy.
Elanso takes the privacy of your personal information very seriously, and will
use your information only in accordance with the terms of this Privacy Policy.
We will not sell or rent your personally identifiable information or a list of our
users to third parties.
This Privacy Policy is effective upon acceptance by new users and is otherwise
effective on July 26th, 2006.
1. An Important Note about Children
Our services are not open to children or persons under 18 years of age without
the explicit supervision of their parents or guardians. We request that children
do not submit any personal information to us.
2. Information We Collect
2.1 Required Information
We collect certain personal information from you in order to allow us to offer
a smoother, more efficient, safer and customized experience for your online transactions.
You will need to register using our online registration form in order to make full
use of our services. During registration, you will be required to provide
us with a user name and an e-mail address which will function as your User ID.
We may require some additional information, such as, but not limited to: your real
name, address, nationality, telephone number and other personal information. We
use your information to verify your name, address, and other contact information.
We automatically track certain information such as your usage pattern and behaviour
on our Site. This information is used in our internal research. This research guides
our efforts to understand and serve you better. User information is compiled and
analyzed on an aggregate basis.
We may use your e-mail address to contact you regarding new services or information.
2.2 Transaction Information
If you choose to bid, buy or sell on our Site, we will collect information about
your bidding, buying, and selling behaviour. We also collect other users' comments,
made in our feedback area, concerning you. We retain information for each transaction
you conduct through Elanso. We also collect the internet address (IP address) of
the computer or device you use to access your Elanso account, in order to help us
detect possible instances of fraud.
2.3 Website Traffic Information
Because of the way that World Wide Web communication standards work, when you
enter or leave the Elanso Site, we automatically receive the web address of the
site that you came from or are going to. We also collect information concerning
which pages of our website you visit while you are on the Elanso Site. This information
may include the URL that you just came from (whether this URL is on our Site or
not), what type of browser you are using, as well as the specific time you access
our website and your IP address.
We use the above information only to try to understand our users' preferences
better and to manage the Internet traffic load on our servers. We do this in order
to improve our service and your experience with Elanso.
2.4 Our Use of "Cookies"
We use data collection devices such as "cookies" on certain pages of
our Site. "Cookies" are small data files that reside on your computer
and allow us to recognize you as an Elanso user if you return to the Elanso site
using the same computer and browser. We send a "session cookie" to your
computer if and when you log in to your Elanso account by entering your e-mail address
and password. These cookies allow us to recognize you if you visit multiple pages
in our site during the same session, so that you don't need to re-enter your password
multiple times. Cookies can also help us provide you with information targeted to
your interests. Cookies are stored on your hard drive, not on our Site. Most cookies
are "session cookies", meaning that they are automatically deleted at
the end of a session. You are free to decline our cookies if your browser permits.
Should you choose to decline our cookies, please bear in mind that you may not be
able to use certain features on our Site and you may be required to re-enter your
password more frequently during a given session.
Additionally, you may encounter "cookies" or other similar devices on
certain pages of our Site that are provided by third parties. For example, if you
view a web page created by a user, there may be a "cookie" placed within
that web page. We do not control the use of cookies by third parties.
2.5 Customer Service Correspondence
If you send us correspondence, including e-mails and faxes, we retain such information
in your account records. We will also retain customer service correspondence and
other correspondence sent from Elanso to you. We retain these records in order to
measure and improve our customer service, and to investigate potential instances
of fraud and/or violations of our User Agreement.
2.6 Questionnaires, Surveys and Profile Data
From time to time, we offer optional questionnaires and surveys to our users for
purposes such as collecting demographic information or assessing users' interests
and needs. The use of the information collected will be explained in detail in any
given survey. If we collect personally identifiable information from our users in
these questionnaires and surveys, prior to their participation in the survey or
questionnaire, users will be given explicit notice of how the information will be
used.
3. Our Use of Your Information
We use personal information about you (including but not limited to information
in the file we maintain about you, and other information we obtain from your current
and past activities on the Site) to resolve disputes, troubleshoot problems, help
ensure safe trading on our Site, and enforce our User Agreement. At times, we may
look at information obtained across multiple users to identify problems or resolve
disputes, and in particular, we may examine your information to identify users attempting
to access Elanso with multiple User IDs or aliases.
In order to limit online fraud, criminal or other illegal activities on our Site,
and protect the Elanso community, you agree to allow Elanso employees and/or systems
to evaluate the personal information you provide. This information may be retained
in our company files and used for evaluation and monitoring purposes.
You agree that we may use personal information about you to improve our marketing
and promotional efforts, to analyse site usage, to improve our content and product
offerings and customise our Site's content, layout, and services. The use of this
information allows us to improve our Site, tailoring it to meet your needs, and
providing you with a smooth, efficient, safe and customised experience.
You agree that we may use your information to contact you and deliver information
to you that, in some cases, is targeted to your interests, such as targeted banners,
administrative notices, product or service offerings, and communications relevant
to your use of the Site. By accepting the User Agreement and Privacy Policy you
expressly agree to receive this information. You can opt to remove yourself from
receiving some of this information. If you do not wish to receive these communications,
we encourage you to "opt-out" using the “Reminder Setting” for your account.
To adjust these settings, go to the "Reminder Setting" section of your
"My Elanso" page.
4. Our Disclosure of Your Information
Although Elanso uses standard industry practices to protect your personal information,
due to technical limitations, we cannot ensure that all of your private communications
and other personal information will never be disclosed in ways not otherwise described
in this Privacy Policy. By way of example (without limiting the foregoing), under
certain circumstances we may be forced to disclose information to the government
or other third parties (further details of which are set out below in the "Legal
Requests" section). It is also possible that third parties may unlawfully intercept
or access transmissions or private communications. Therefore, although we use standard
industry practices to protect your privacy, we cannot and do not guarantee, and
you should not expect, that your personal information or private communications
will always remain private.
As a matter of policy, we do not sell or rent any personal information about you
to any third party. However, the following describes some of the ways in which your
personal information may be disclosed. By agreeing to the User Agreement and Privacy
Policy you expressly agree that your personal information may be disclosed by Elanso
in the following ways:
4.1 Your Agent or Legal Representative
We may disclose information to your agent or legal representative (such as the
holder of a power of attorney that you grant).
4.2 Advertisers
By gathering personal information from all user accounts, we develop an aggregate
information database for Elanso users. We may disclose such information in a non-personally
identifiable manner to advertisers and other third parties for marketing and promotional
purposes.However, in these situations, we do not disclose to these entities any
information that could be used to identify you personally. Certain information,such
as your name, e-mail address, password, credit card number, and bank account number,
will never be disclosed to advertisers. However the information that the advertiser
get from analyzing your Elanso name and other open information are not restricted
to this.
4.3 The Elanso Community
Throughout the Site, you are identified by your User ID (the e-mail address that
you used to register with Elanso) and your Elanso name. Your user name can be used
to identify you and your activities throughout the Site. Other people can see your
bids, projects to which you have contributed in the past, your postings on the Site,
your feedback rating and associated comments and so on. We also provide a number
of ways for other users to find out more about you and your Site activities, for
example, one of our features allows users to see quickly all of the services you
are offering at the time. If you are involved in a transaction, we have a feature
that allows other users to view your e-mail address and obtain your contact information.
4.4 External Service Providers
We share aggregated statistical data with our business partners and this data
is also used for public relations. However, this aggregated information is not tied
to personally identifiable information.
There are a number of services offered by external service providers that help
you use our Site (e.g., co-branded sites, listing agents, escrow, authentication,
mediation). If you choose to use these optional services, disclose personal information
to the external service providers, and/or grant them permission to collect personal
information about you, then their use of your personal information is governed by
their privacy policy. We may, for your convenience, provide some of your personal
information to the external service provider offering such services. However, before
we disclose your personal information to an external service provider, you will
have the opportunity to see what data is to be sent and will also have the ability
to approve or disapprove of the disclosure. To prevent our disclosure of your personal
information to an external service provider, you can decline such disclosures or
simply not use these services. Because we do not control the privacy practices of
these third parties, you should evaluate their practices before deciding to use
their services.
4.5 Internal Service Providers
We may use internal service providers to facilitate our services (e.g. search,
discussion boards and surveys) and therefore we may provide some of your personal
information directly to them. In some instances, the internal service provider may
collect information directly from you (for example, we may ask an internal service
provider to conduct a survey for us). In these cases, you will be notified of the
involvement of the internal service provider, and all information disclosures you
make will be strictly optional. In all cases, these internal service providers'
use of information we supply them is restricted by confidentiality agreements. If
you provide additional information to an internal service provider directly, then
their use of your information is governed by their privacy policy.
4.6 Other Corporate Entities
As allowed by applicable law, we share much of our data, including personal information
about you, with our subsidiaries and joint ventures throughout the world to help
coordinate the services we provide to you, enforce our terms and conditions, and
promote trust and safety. The personal information we collect is stored on Elanso
servers located in China. To the extent that other corporate entities have access
to your information, they will treat it at least as protectively as they treat information
they obtain from their other users.
It is possible that Elanso could merge with or be acquired by another business
entity. Should such a combination occur, you should expect that Elanso would share
some or all of your information in order to continue to provide you with services.
You will receive notice of such an event (to the extent it occurs) as described
in Section
10 ("Notification of Changes"). We will require that the new combined
entity follow the practices disclosed in this Privacy Policy.
4.7 Legal Requests
Elanso may lawfully disclose your personal information to comply with legal enforcement
or for regulatory purposes. Elanso cooperates with legal enforcement inquiries and
other third parties to enforce laws, as well as intellectual property and other
rights. We can (and you authorise us to) disclose any information
about you to law enforcement or other governmental officials as we, in our sole
discretion, believe necessary and appropriate, in connection with an investigation
of fraud, intellectual property infringements, piracy or other activity that is
illegal or may expose us to legal liability.
We disclose information that we, in good faith, believe is appropriate and necessary
for our cooperation in investigations of fraud or other illegal activities, or to
conduct investigations of violations of our User Agreement. For example, in the
unlikely case that we conduct a fraud investigation and conclude that one side has
engaged in deceptive practices, we may give information necessary for the investigation,
including but not limited to, that person or entity's contact information, to victims
who request it.
We may disclose information in response to a subpoena, warrant, court order, levy,
attachment, order of a court-appointed receiver or other comparable legal process,
including subpoenas from private parties in a civil action.
5. Your Use of Other Users' Information
In order to facilitate interaction among all Elanso users we grant you limited
access to other users' contact information. Elanso users who are Clients have access
to the User ID, e-mail address and other contact information of the translators
or the bid winners of each project they post. Translators or bid winners, have access
to the User ID, e-mail address and other contact information of the Clients.
By accepting our User Agreement, you agree that, with respect to other users'
personal information obtained through the Site, through an Elanso-related communication
or an Elanso-facilitated transaction, Elanso hereby grants you a license to use
such information only for:
(a) Elanso-related communications that are not unsolicited commercial messages,
(b) using services offered through Elanso (e.g. fraud complaints), and
(c) any other purpose that such user expressly opts into after adequate disclosure
of the purpose(s).
In all cases, you must provide other users with the opportunity to remove themselves
from your database and review any information you have collected about them. In
addition, under no circumstances, except as defined in this Section, can you disclose
personally identifiable information about another user to any third party without
our consent and the consent of such other user. Note that law enforcement personnel
and other rights holders are given different rights with respect to information
they access.
Elanso and its users do not tolerate spam. Therefore, without limiting the foregoing,
you are not licensed to add an Elanso user, even a user who has previously engaged
in a transaction with you, to your mailing list (e-mail or physical mail) without
their express consent and after adequate disclosure. To report spam from other Elanso
users, please send an e-mail to us at: report@elanso.com.
6. Use of E-mail Tools
You may not use the “Send a Message to Your Friends” service, or other e-mail
forwarding services that we offer, to send spam or send content that would otherwise
violate our User Agreement or Privacy Policy.
If you send an e-mail using the “Send a Message to Your Friends” service to an
e-mail address that is not registered in our community, we do not use that e-mail
address for any purpose other than to send your e-mail. We do not rent or sell these
e-mail addresses. We do not permanently store the e-mail messages or the e-mail
addresses.
7. Information Security
7.1 Control of Your Password
The security of, and all actions taken with, your User ID and password are your
sole responsibility. You, therefore, shall not disclose your Elanso password to
anyone. Disclosure of your password will compromise the security and protection
of your personal information, and may make you legally liable for any binding actions
taken on your behalf. Therefore, if you believe that your password has been compromised
for any reason, you should immediately change your password.
We will never ask you to send your password or other sensitive information to
us in an e-mail, though we may ask you to enter this type of information on the
Elanso website. Anytime you are asked to enter a password or other sensitive information,
you will be provided with a URL beginning with https://www.elanso.com/.
7.2. Your Publishing Information
All of your Publishing Information will be publicly available on the Elanso site
and therefore accessible by any Internet user. Any Publishing Information that you
disclose to Elanso becomes public information and you relinquish any proprietary
rights (including but not limited to the rights of confidentiality and copyrights)
in such information. You should exercise caution when deciding to include personal
or proprietary information in the Publishing Information that you submit to us.
8. Deactivating Your User Account
Upon your request, we will deactivate your account and your personal information
from our active databases. To make this request, please send an e-mail to us at
help@elanso.com. Your information will be deactivated
as soon as reasonably possible in accordance with our deactivation policy and applicable
law.
In some circumstances, we may retain in our files information you have requested
that we remove. These circumstances include, but are not limited to, fraud prevention,
dispute resolution, problem troubleshooting, assistance with any investigations,
enforcement of our User Agreement, and compliance with legal requirements.
Further, such information is never completely removed from our databases due to
technical constraints and the fact that we back up our systems. Therefore, you should
not expect that all of your personal information will be completely removed from
our databases in response to your requests. However, such information will be deactivated
from public viewing and usage, including that of other Elanso users. After the deactivation
of your account, your information will be available only to selected Elanso personnel.
9. Other Information Collectors
This document addresses only the use and disclosure of information we collect
from you, except as otherwise expressly discussed in this Privacy Policy. To the
extent that you disclose your information to other parties, whether they are bidders,
Clients or Translators on our Site or other sites throughout
the Internet, different rules may apply to their use and/or disclosure of the personal
information you provide them. Since Elanso does not control the privacy policies
of third parties, you are subject to the privacy policies of any third party to
whom you disclose your information. We encourage you to ask questions before you
disclose your personal information to others.
10. Notification of Changes
This Privacy Policy will be revised from time to time, at our sole discretion,
due to changes in the services offered by Elanso or incorporation of suggestions
from our users. All changes to this Privacy Policy are effective immediately after
we post the changes on our Public Message Board. If you continue to use Elanso services
as of the above mentioned effective date, it indicates that you have read, fully
understood, and agreed to be bound by the revised terms and conditions of the Privacy
Policy. If you do not accept the revised Privacy Policy, you must stop using our
services. In the event of a dispute between a User and Elanso, resolution will be
based upon the latest updated version of the Privacy Policy.
